Terms and Conditions of Savorly

Welcome to Savorly.

These Terms and Conditions govern access to and use of the Savorly platform, including its website, admin panel, digital menus, public pages accessible via QR code, and any other functionality associated with the service.

By registering for, accessing, or using Savorly, you agree to be bound by these Terms and Conditions. If you do not agree with them, you should not use the platform.

1. Service Identification and Contact

Hereinafter, the "Owner," "Savorly," "we," or "the platform."

For any contractual or service use inquiries, you may write to support@savorly.me.

2. Service Description

Savorly is a digital platform that enables restaurants, bars, cafés, hotels, or other hospitality businesses to create, manage, and publish their digital menus.

Through Savorly, businesses can, among other functionalities:

  • Create and manage their restaurant profile.
  • Add menu sections, dishes, beverages, prices, images, ingredients, allergens, tags, and descriptions.
  • Generate links or QR codes for consumers to access the digital menu.
  • Display the menu on a public page accessible from mobile devices.
  • Manage information visible to consumers.
  • Access additional features according to the contracted plan, such as translations, statistics, images, product availability, recommendations, or other functionalities that may be added in the future.

Savorly acts solely as a technology provider. Savorly is not a restaurant, does not sell food or beverages, does not prepare orders, and does not directly intervene in the commercial relationship between the restaurant and its customers.

3. Platform Users

On Savorly, there may be different types of users:

3.1. Professional Users or Restaurants

These are owners, managers, employees, or authorized representatives of a restaurant or business who use the Savorly back office to create and manage their digital menu.

These users are responsible for the information they enter, modify, or publish on the platform.

3.2. Consumers or Visitors

These are individuals who access a restaurant's public digital menu via QR code, web link, or other means.

Consumers can view information published by the restaurant but do not necessarily need to create a Savorly account to access the public menu.

4. Registration and User Account

To access the Savorly admin panel, the restaurant or professional user must create an account by providing truthful, current, and complete information.

The user agrees to:

  • Provide accurate and current data.
  • Maintain the confidentiality of their credentials.
  • Not share their account with unauthorized persons.
  • Notify Savorly of any unauthorized use of their account.
  • Be responsible for all activity conducted from their account.

Savorly may suspend or cancel an account if it detects false information, fraudulent use, violation of these terms, or activity that may harm the platform, other users, or third parties.

5. Responsibility for Restaurant Content

The restaurant is solely responsible for content it creates, uploads, edits, or publishes on Savorly.

This includes, without limitation:

  • Restaurant name.
  • Address, hours, and contact information.
  • Images of premises, dishes, beverages, or products.
  • Dish names.
  • Descriptions.
  • Ingredients.
  • Allergens.
  • Prices.
  • Product availability.
  • Translations.
  • Promotions.
  • Tags, recommendations, or featured information.

The restaurant declares and warrants that:

  • It has the right to use and publish content uploaded to Savorly.
  • Published information is truthful, current, and not misleading.
  • Images, texts, or trademarks used do not infringe third-party rights.
  • Information about allergens, ingredients, and prices is kept current.
  • It complies with regulations applicable to its activity, including food, health, consumer, pricing, advertising, and data protection regulations.

Savorly does not permanently review nor guarantee the accuracy of content published by restaurants.

6. Menu Publication via Links and QR Codes

The restaurant understands and agrees that the primary purpose of Savorly is to publish its digital menu on a publicly accessible page via web link, QR code, or similar means.

Therefore, information that the restaurant marks as visible or public may be viewed by anyone who accesses the link or scans the corresponding QR code.

This may include, among other data:

  • Restaurant trade name.
  • Restaurant images.
  • Digital menu.
  • Dishes and beverages.
  • Prices.
  • Descriptions.
  • Ingredients.
  • Allergens.
  • Tags or recommendations.
  • Contact or location information, if the restaurant publishes it.

7. Information About Prices, Ingredients, and Allergens

Savorly may allow the restaurant to publish information about ingredients, allergens, prices, availability, dish characteristics, recommendations, or other menu-related data.

However:

  • Savorly does not guarantee that such information is complete, correct, or current.
  • The restaurant is solely responsible for keeping that information current.
  • Consumers should confirm any sensitive information directly with restaurant staff before placing an order or consuming a product.
  • In case of allergies, intolerances, dietary restrictions, or medical needs, consumers should always consult with the restaurant before consuming.

Savorly will not be responsible for damages, harm, allergic reactions, price errors, unavailability, or any consequences arising from incorrect, incomplete, or outdated information published by the restaurant.

8. Automatic Translations and Technology-Generated or Assisted Content

Savorly may offer automatic translation, text generation assistance, suggestions, recommendations, description improvements, or other technological tools.

The restaurant understands that these features may contain errors, inaccuracies, or incorrect interpretations.

Therefore:

  • Translations should be reviewed by the restaurant before publishing.
  • Generated or suggested descriptions should be verified.
  • Information about ingredients, allergens, prices, or product characteristics should not rely exclusively on automatic tools.
  • The restaurant remains responsible for the final content shown to the public.

Savorly does not guarantee that translations or generated texts are accurate, complete, or suitable for all contexts.

9. Permitted Use of the Platform

The user agrees to use Savorly lawfully, responsibly, and in accordance with these terms.

Prohibited:

  • Using Savorly for illegal, fraudulent, or unauthorized purposes.
  • Publishing false, misleading, offensive, discriminatory, defamatory, or unlawful content.
  • Uploading images, texts, trademarks, or materials without authorization.
  • Accessing or attempting to access other users' accounts.
  • Manipulating, damaging, overloading, or interfering with platform operation.
  • Reverse engineering, copying, modifying, or improperly exploiting Savorly software.
  • Using the platform to send spam, malware, or unsolicited communications.
  • Using Savorly in a way that may harm the reputation, security, or operation of the service.

Savorly may remove content, limit functionality, suspend accounts, or cancel service if violations are detected.

10. Plans, Pricing, and Subscriptions

Savorly may offer different free or paid plans, with specific features, limits, and conditions.

Details of each plan, including price, frequency, included features, and limitations, will be available on the pricing page or during the contracting process.

Unless otherwise stated:

  • Subscriptions are billed on a recurring basis.
  • Access to premium features depends on active payment of the corresponding plan.
  • Savorly may modify its prices, plans, or features, notifying relevant changes when appropriate.
  • Non-payment may result in suspension, limitation, or cancellation of service.

Currently, Savorly offers the following plans: Basic, Professional, and Premium, whose specific conditions will be displayed on the platform's pricing page.

11. Payments and Billing

Payments are processed through Stripe.

Savorly does not directly store complete bank card data when payment is processed by Stripe. The processing of such data will also be governed by Stripe's terms and policies.

The user agrees to provide valid and current billing information.

In case of payment error, non-payment, refund, fraud, or misuse, Savorly may suspend or cancel service access.

12. Subscription Cancellation

The user may cancel their subscription according to the procedure enabled on the platform or by contacting Savorly.

Unless expressly stated otherwise:

  • The subscription renews automatically each month unless canceled before the next billing cycle.
  • The user may continue accessing the contracted plan until the end of the already paid period.
  • Refund requests must be made directly to Savorly and will be reviewed on a case-by-case basis.

13. Free Trials, Promotions, and Beta Periods

Savorly may offer free trials, discounts, promotions, beta access, or special conditions to certain restaurants.

These conditions may have limited duration and be subject to specific requirements.

In case of free or beta access:

  • Savorly may modify, limit, or terminate such access with reasonable notice.
  • Some features may be in testing phase.
  • There may be errors, frequent changes, or interruptions.
  • Beta access does not guarantee indefinite availability or maintenance of the same commercial conditions in the future.

14. Intellectual Property of Savorly

Savorly, including its software, design, interface, trademark, logo, structure, features, code, proprietary texts, documentation, and visual elements, belongs to the Owner or its licensors.

Use of the platform does not grant the user any ownership rights over Savorly.

Copying, reproducing, distributing, modifying, selling, renting, sublicensing, or exploiting any part of Savorly without express written authorization is prohibited.

15. Content Uploaded by the Restaurant

The restaurant retains ownership of content uploaded to the platform, provided it has rights to it.

However, by uploading content to Savorly, the restaurant grants Savorly a non-exclusive, worldwide, royalty-free, and limited license to store, process, reproduce, display, technically adapt, and publicly communicate such content to the extent necessary to provide the service.

This license allows, for example:

  • Displaying the menu on the restaurant's public page.
  • Optimizing images for mobile loading.
  • Storing backups.
  • Displaying dishes, prices, descriptions, or images to consumers.
  • Generating public views accessible via QR.
  • Performing technical adaptations necessary for platform operation.

This license will end when content is removed from the platform, unless it is necessary to retain it for legal obligations, temporary backups, or defense against claims.

16. Images and Third-Party Rights

The restaurant warrants that it has the necessary rights, licenses, or authorizations to use images, logos, trademarks, photographs, texts, and any other content it uploads to Savorly.

Savorly will not be responsible for claims arising from unauthorized use of content protected by intellectual property rights, industrial rights, image rights, or third-party rights.

In case of a claim, Savorly may remove the affected content and suspend the responsible user's account.

17. Service Availability

Savorly will attempt to keep the platform available and functioning correctly, but does not guarantee continuous, uninterrupted, or error-free availability.

The service may be affected by:

  • Scheduled maintenance.
  • Updates.
  • Technical failures.
  • Connectivity issues.
  • Security attacks or incidents.
  • Third-party services.
  • Force majeure.

Savorly will not be responsible for temporary interruptions, loss of availability, technical errors, or inability to access when due to causes reasonably beyond its control.

18. Service Modifications

Savorly may modify, update, suspend, or remove platform features to improve the service, fix errors, adapt the product to technical, legal, or commercial changes, or ensure system security and stability.

When changes significantly affect contracted features, Savorly will attempt to inform the user with reasonable advance notice whenever possible.

19. Limitation of Liability

Savorly is provided as a technological tool for managing and publishing digital menus.

To the maximum extent permitted by law, Savorly will not be responsible for:

  • Incorrect, incomplete, or outdated information published by restaurants.
  • Errors in prices, ingredients, allergens, availability, or descriptions.
  • Consumer claims against restaurants.
  • Damages arising from food or beverage consumption.
  • Data loss caused by incorrect platform use.
  • Temporary service interruptions.
  • Automatic translation errors or technology-assisted content.
  • Indirect damages, loss of profits, loss of revenue, loss of reputation, or loss of business opportunities.
  • Content uploaded by users that infringes third-party rights.
  • Issues arising from external services such as hosting, payment providers, email, analytics, storage, or translation tools.

20. Relationship Between Restaurant and Consumer

Savorly is not part of the contractual, commercial, or consumer relationship between the restaurant and its customers.

Any order, reservation, purchase, in-house payment, claim, incident, return, complaint, or request related to the restaurant's food, beverages, or services must be managed directly between the consumer and the restaurant.

Savorly does not guarantee the quality, safety, availability, price, or characteristics of products offered by the restaurant.

21. Future Ordering or Table Interaction Features

Savorly may incorporate features that allow consumers to place orders, send requests, call the waiter, rate dishes, save preferences, or interact with the restaurant from the digital menu.

Unless expressly stated otherwise, these features will act as communication or management tools for the restaurant.

The restaurant will remain responsible for accepting, rejecting, preparing, charging for, or managing any order or request received.

Savorly will not be responsible for delays, operational errors, unattended orders, product availability, or conflicts between the restaurant and its customers.

22. Data Protection

The processing of personal data is governed by the Savorly Privacy Policy, which is an integral part of these Terms and Conditions.

By using Savorly, the user agrees to have their data processed in accordance with said policy.

23. Communications

Savorly may send the user communications related to:

  • Account management.
  • Important service changes.
  • Billing.
  • Security.
  • Support.
  • Legal updates.
  • Operational information necessary for platform use.

When applicable, marketing or promotional communications will be sent only if there is a legal basis and the user may unsubscribe in accordance with applicable regulations.

24. Account Suspension or Cancellation

Savorly may suspend or cancel an account, temporarily or permanently, if:

  • The user violates these Terms.
  • Fraudulent or abusive use is detected.
  • There are unpaid debts.
  • Unlawful content is published or content that infringes third-party rights.
  • Platform use harms other users, consumers, third parties, or the service itself.
  • It is required by a competent authority.
  • There are security risks.

In case of cancellation, Savorly may delete or deactivate access to content associated with the account, unless there is a legal obligation to retain it.

25. Service Termination and Data Deletion

The user may request account termination by contacting Savorly or using tools enabled on the platform, if any exist.

Data deletion will be carried out in accordance with the Privacy Policy and applicable legal obligations.

26. Third-Party Services

Savorly may integrate with or depend on third-party services to provide certain features, such as:

  • Hosting or infrastructure.
  • Stripe for payments.
  • OpenAI and Anthropic for translation or text assistance functions, when applicable.
  • Technical tools necessary for storage, security, and platform operation.

Savorly does not fully control such services and will not be responsible for failures, interruptions, changes, terms, or policies of third parties.

Use of some services may be subject to additional terms from the respective provider.

27. Changes to These Terms

Savorly may modify these Terms and Conditions when necessary for legal, technical, commercial, or service improvement reasons.

When changes are significant, Savorly will attempt to communicate this via the platform, email, or other reasonable means.

Continued use of Savorly after new terms take effect implies acceptance of them.

If the user does not agree with the changes, they should stop using the service and, where applicable, cancel their subscription.

28. Applicable Law and Jurisdiction

These Terms and Conditions will be governed by Spanish law, unless consumer protection regulations state otherwise.

For any dispute arising from the use of Savorly, the parties submit to the courts that correspond according to applicable legislation.
